TERMS & CONDITIONS

You (the undersigned with the name and details mentioned below, hereinafter referred to as “You” or “Your” ) agree and understand that this is an agreement entered into between You and TSI Mental Health LLP having its Registered Office at Plot No. 107, S.No.26, Kshitij Apartments, Dahanukar Colony, Kothrud Khadakwasla R.S. Pune – 411024 which shall include its employees, partners, assigns (hereinafter referred to as “TSI” or ”We” or “us”) with respect to the services provided by TSI pertaining to the Counselling sessions (“Sessions”).

 

The Parties agrees as follows:
1. You understand that COUNSELING is a confidential and private process designed to assist You with Your concerns, come to a greater understanding of Yourself, and learn effective personal and interpersonal coping strategies. TSI is engaged in such aforesaid activity of counselling and in its course has on-boarded multiple qualified counsellors (“Counsellor(s)”). While You seek our consultancy, our consultancy involves a relationship between You and TSI to assist You in accomplishing Your individual goals. Counselling involves sharing sensitive, personal, and private information that may at times be distressing. In course of counselling, there may be periods of increased anxiety or confusion. The outcome of counselling is generally positive; however, the level of satisfaction for any individual is not predictable or guaranteed as that depends upon many factors.


2. CONFIDENTIALITY: All interactions with the Counsellor, including scheduling of or attendance at appointments, telephonic conversation, content of Your Sessions, notes, progress in counselling, and Your records including financial or business records are confidential (“Confidential Information”). No record of counselling Sessions is
contained in any academic, educational, or job placement file. Any information provided by You which is already in public domain or which the Counsellor or TSI already possess (in writing), shall not amount to “Confidential Information”. TSI requires the Counsellor to discuss their work with their supervisor/s/Managers from time to time. Any information received by the Supervisor/s shall be considered confidential in nature, being subjected to the same ethical criteria as the Counsellor.


3. LIMITATIONS TO CONFIDENTIALITY: In certain situations, Counsellor are required by law to reveal information obtained during therapy/Sessions to other persons or agencies without Your consent. In such situations, the Counsellor is not required to inform You of his/her actions. Please note the following limitations to confidentiality:

a) Confidentiality obligation does not apply to cases of suspected abuse/neglect of children or the elderly.
b) Confidentiality obligation does not apply to cases of potential harm to self or others.
c) A Counsellor may disclose Confidential Information in legal proceedings brought by You or against You.
d) Confidentiality obligation does not apply to cases involving criminal proceedings, except communications by a person voluntarily involved in a substance abuse program.
e) Confidentiality obligation may not apply in cases involving legal proceedings including affecting the parent-child relationship.

f) Confidentiality obligation may not apply to cases involving a minor child. In such cases, the Counsellor may advise a parent, managing conservator or guardian of a minor, with or without minor’s consent, of the treatment needed by or given to the minor.
g) Confidentiality may not apply in case the counselling Sessions are being conducted in course of Your legal proceedings including divorce proceedings. Confidentiality may not apply if we are bound by any court order issued by an appropriate court or any order issued by any appropriate governmental body.

In all the above cases, it is incumbent upon the Counsellors to release only such information necessary to appropriately carry out his/her responsibilities. Your confidentiality obligation still remains an ethical priority.


4. DISCLAIMER OF WARRANTIES:
TSI (and/or Counsellor) expressly disclaims any expressed or implied warranties of the accuracy or fitness of the counselling for a particular purpose. Counselling may not be right for You in case You are in any legal proceeding which challenges Your soundness of mind, especially in case You are in divorce proceedings. TSI shall not submit its data including Your reports unless it received an order of the appropriate court to that effect.


5. LIMITATION OF LIABILITY:
In no event shall TSI, be liable for direct, indirect consequential, special, indirect, incidental claims, punitive or exemplary loss, damage, or expense relating to this Agreement (whether in contract, statute, tort (such as negligence), or otherwise). The maximum liability of TSI in any case whether in contract, tort, misconduct or negligence would be 30% of the fees paid by You to TSI (Liquidated damages). However, You would remain liable to TSI in case of any loss or damage to property or person.


6. PROFESSIONAL ETHICS
As a part of the client-therapist/Counsellor code of ethics, following are a few things to keep in mind:
a) As a Counsellor, an encounter with You in a social setting shall only be acknowledged if You acknowledge the Counsellor first, in his/her comfort.
b) To maintain boundaries, a Counsellor shall not accept requests from the client on any third-party/social platforms. (E.g: Facebook, Instagram, Twitter, LinkedIn)
c) The Counsellor will be available on Call/WhatsApp (Based on the timings given by the Counsellor) only for You to book an appointment for their sessions. (Exceptions only in case of a telephonic session planned with the client
beforehand).
d) No calls/emails/messages regarding Your personal concerns shall be entertained by the Counsellor or TSI. This shall be addressed only in a therapeutic setting i.e. TSI’s clinic or a scheduled telephonic/online session.

7. Our relation shall be governed in accordance with the laws of India and the parties hereto irrevocably submit to the exclusive jurisdiction of the courts in Pune, India.

 

You hereby declare that you have read and understood these terms and conditions carefully and by using, accessing the Counselling Sessions/ services of TSI:
a. You indicate Your understanding and acceptance of these terms, the risks and benefits of counselling, the nature and limits of confidentiality, and what is expected of You as a client; and
b. You provide Your consent to access the personal data being held by TSI and to use Your personal and sensitive data for the purpose of delivering counselling Sessions alongwith the permit to use the data for the purposes of improving and management of the quality of Sessions/services being delivered by TSI and
c. You shall not hold the Counsellor and/or TSI responsible for any effect, which is contingent, unexpected, and sudden due to any condition including the medical conditions or psychological conditions
.
